PAYMENT TERMS: Thomson Concrete provides quotes and orders on a prepaid basis, except where the Purchaser has established a credit limit with Thomson Concrete.

RETURNS & CANCELLATIONS: Thomson Concrete shall give no credit for concrete returned from the Purchaser. In case of error by Thomson Concrete, the Purchaser agrees to notify Thomson Concrete immediately. Purchaser agrees that Thomson Concrete will acept no cancellation of a delivery after concrete has been loaded onto Thomson Concrete’s truck.

WASHDOWN: Purchaser agrees to provide suitable wash down areas for Thomson Concrete trucks at the Purchaser’s delivery location.

RESPONSIBILITY FOR HANDLING: Thomson Concrete's responsible for handling concrete ceases immediately upon delivery to the Purchaser. The effect of the climate conditions on the concrete when pouring and curing shall be the sole responsibility of the Purchaser. Additional water added to theconcrete will reduce its strength. If additional water is added, Thomson Concrete will not be responsible for final strength. Thomson Concrete does not guarantee finished results obtained from concrete, as many important factors affecting the ultimate quality of the completed job are out of our control. Thomson Concrete is not responsible for concrete color.

DELIVERY AND INDEMNIFICATION: All concrete ordered and in the process of bing loaded or already loaded is the property of the Purchaser. The Purchaser agrees that all concrete delivered by Thomson Concrete beyond the curb line is at the risk of the Purchaser. When the Purchaser or the Purchaser's agent directs Thomson Concrete to cross over the curb line, the Purchaser agrees to indemnify and hold harmless Thomson Concrete from any liability or damage to the curb, sidewalk, underground tanks, driveways, lawns, trees or buildings. TRUCKS WILL ENTER UPON CUSTOMER'S PROPERTY AT ENTIRE RISK OF CUSTOMER. We will not assume responsibility for any damage caused by our trucks when required to make delivery anywhere off a paved public street or roadway. CUSTOMER IS RESPONSIBLE FOR ANY WRECKER FEES.

DELIVERY SITE CONDITIONS: Thomson Concrete reserves the right to determine whether the Purchaser's delivery site is suitable for such delivery. Thomson Concrete may refuse to deliver to the Purchaser's site if Thomson Concrete is of opinion that the delivery would be unsuitable or unsafe. The Purchaser shall be responsible for all cost and damages incurred where Thomson Concrete does not have adequate access for delivery.

DELIVERY TICKETS: Thomson Concrete will account for products delivered using delivery tickets. The delivery ticket constitutes Purchaser's acknowledgment that Thomson Concrete has delivered products that meet all the contract specifications and requirements, subject to further testing by the Purchaser. The Purchaser agrees that the Purchaser or the Purchasers agent shall be present for all deliveries and available to sign delivery tickets promptly.

UNATTENDED DELIVERY SITE: When the Purchaser requires Thomson Concrete to deliver products to a site at a place where and time when the Purchaser and the Purchaser's agent are not present, Thomson Concrete shall not be liable for any loss or damage to products or property or for delivery tickets that the Purchaser and the Purchaser's agent are not available to sign.

CONFIDENTIALITY: Purchaser acknowledges that the information provided by Thomson Concrete in quotations is confidential, and Purchaser agrees not to disclose it without the express written permisson of Thomson Concrete. Purchaser acknowledges that the information in quotations, other than information that is public domain by other means, is in all respects confidential in nature and that any disclosure of the same by the Purchaser may cause serious harm or damage to Thomson Concrete
